1. Introduction 1.1 Agreement: These Terms and Conditions govern the use of the online services provided by LEXFILE GLOBAL for Company Registration, Business Licenses, and various other legal services. By using Our services (“We”, “Us”, “Our”), you (“Client”, “You”, “Your”) agree to be bound by this Agreement.
2. Services 2.1 Scope of Services: LEXFILE GLOBAL assists clients with the processing of applications for services such as Company Registration, Business Licenses, Import-Export Documents, ISO & Quality Certifications, Taxation, Trademark/IPR, Documentation, Information Technology (IT), and Consultation services. However, LEXFILE GLOBAL does not directly issue certificates and licenses and, therefore, cannot guarantee their issuance. 2.2 No Legal Advice: Our services may include the preparation of legal documents and the provision of information. However, this should not be considered legal advice. We are not a law firm, and the information provided by us should not be interpreted as legal advice or opinion. 2.3 Service Limitations: LEXFILE GLOBAL will not engage in or assist with any business activities or transactions that are considered haram (forbidden) under Shariah law, including but not limited to businesses involving alcohol, pork products, pornography, gambling, and interest-based financial services. We do not guarantee that all applications for registration will be successful, nor are we responsible for issuing certificates and licenses.
3. Client Responsibilities 3.1 Accurate Information: You agree to provide accurate, current, and complete information as required for the registration process. You are responsible for ensuring that the information provided is correct. 3.2 Compliance with Laws: You agree to comply with all applicable laws and regulations in the jurisdiction in which you are registering your business. 3.3 Use of Services: You agree to use the Services only for lawful purposes and in accordance with this Agreement.
4. Refund Terms 4.1 No Refunds for Completed Services: Due to the nature of our services, all fees paid are non-refundable once the service has been commenced or completed. 4.2 Request for Refund Before Service Commencement: If you request a refund before we have commenced work on your application, we may, at our sole discretion, offer a refund minus any processing or consultancy fees.
5. Exceptions to the No Refund Policy 5.1 Service Errors: If a refund request is based on an error made by us, such as filing incorrect information due to our fault, we will correct the error at no additional charge or, at our discretion, issue a full or partial refund. 5.2 Service Cancellation by Company: If we are unable to provide the service due to unforeseen circumstances, we will offer a full refund of any fees paid. 5.3 Partial Refunds: In cases where only part of the service has been delivered, we may offer a partial refund based on the proportion of work completed. This is at our discretion and subject to an administrative fee.
6. Process for Requesting a Refund 6.1 How to Request a Refund: To request a refund, you must contact our customer service team at info@lexfileglobal.com within the same business day of the issue arising. Please include your application number, details of the service purchased, and the reason for your refund request. 6.2 Review and Response: We will review your refund request within 7 business days of receipt. You will be notified via email or another form of communication regarding the outcome of your request. 6.3 Refund Processing Time: If approved, refunds will be processed within 7 business days and credited to the original method of payment. Processing times may vary depending on your financial institution.
7. Non-Refundable Services 7.1 Government Fees: Any fees paid to government agencies (e.g., state or central filing fees) are non-refundable, as these are beyond our control once submitted. 7.2 Third-Party Services: Fees paid for third-party services, including but not limited to registered agent services, are non-refundable after the service has been initiated or payment has been made to the third party. 7.3 Expedited Services: Fees for expedited or rush services are non-refundable once we have begun processing your application.
8. Disputed Charges 8.1 Chargebacks: If you initiate a chargeback or dispute a payment with your credit card company or financial institution, we reserve the right to suspend or terminate your account and take legal action to recover any owed amounts.
9. Modification Policy 9.1 Modification: We reserve the right to modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the modified terms.
10. Intellectual Property 10.1 Ownership: All intellectual property rights in the services, including but not limited to software, design, text, and graphics, are owned by or licensed to LEXFILE GLOBAL. 10.2 License: You are granted a non-exclusive, non-transferable license to use the services for personal or internal business purposes only. 10.3 Restrictions: You may not copy, modify, distribute, sell, or lease any part of our services or included software.
11. Confidentiality 11.1 Confidential Information: Both parties agree to keep confidential any proprietary information disclosed during the term of this Agreement. This obligation continues even after the termination of the Agreement. 11.2 Exclusions: Confidential Information does not include information that is public knowledge or that was known before disclosure by the disclosing party.
12. Data Protection 12.1 Data Security: We implement optimal measures to protect your data. You agree that we are not liable for any unauthorized access to your data unless due to our negligence.
13. Termination 13.1 Termination by Client: You may terminate this Agreement at any time by notifying us via email or WhatsApp. Voluntary termination does not entitle you to a refund. 13.2 Termination by Company: We may terminate this Agreement immediately if you breach any terms of this Agreement or if we suspect illegal activity. 13.3 Effects of Termination: Upon termination, you will cease all use of the services, and any outstanding payments will become immediately due.
14. Liability 14.1 Limitation of Liability: To the maximum extent permitted by law, LEXFILE GLOBAL will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the services. 14.2 Maximum Liability: Our maximum liability under this Agreement shall not exceed the total fees paid by you for the services.
15. Dispute Resolution 15.1 Governing Law: This Agreement is governed by the laws of India, with jurisdiction limited to the courts of Mumbai. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of Mumbai.
